Note:Met dank aan Prof. Susan L'Engle, St. Louis.
Book 10 of the Digest is concerned with the regulations of boundaries between properties, usually rural estates, and miniatures for this book usually show some type of object involved with the establishment of these boundaries; in the case of your miniature, a tree is the boundary marker separating one property from another.
The manuscript can be dated to ca. 1260-1270 in terms of its figure style and penwork, and was very likely produced in Bologna through the university pecia system, although there is no evidence on this leaf. The two manuscripts listed below by the same workshop were likely produced through Bologna University as well, but I have not had time to look for pecia marks on the digital copies. The work of this illuminators' workshop is in the "first style" of Bolognese illumination, as established by Alessandro Conti in his publication La miniature Bolognese: Scuole e botteghe, 1270-1340 (Bologna, 1981).
So far Prof. L'Engle has located two manuscripts with miniatures by the same workshop: Biblioteca Apostolica Vaticana, MS Pal. lat. 766, a Codex, the fourth volume of Justinian's corpus of Roman law. Another similar workshop manuscript is Paris, Bibliothèque nationale de France, MS Latin 4472, an Infortiatum, also datable to 1260-1270
