AUCTIONS

ALGEMENE VERKOOPSVOORWAARDEN

1. De openbare verkoping heeft plaats onder toezicht van het ambt van Philippe Willems, gerechtsdeurwaarder, Gistelsesteenweg 418 te 8200 Brugge-Sint-Andries.

2. De verkoop geschiedt tegen contante betaling in euro.

3. De kopers betalen een opgeld ten bedrage van 24 % op het laatste bod, inclusief btw en veilingkosten. Op bepaalde loten van originele kunst waarvan de kunstenaar minder dan 70 jaar overleden is, is daarenboven een volgrecht van 4 % op de hamerprijs verschuldigd, vanaf 2000 euro.

4. In geval van onmiddellijke betwisting wordt het lot heropgeroepen en alle eventuele geschillen worden terstond en in laatste aanleg door de werkende gerechtsdeurwaarder beslecht.

5. Tijdens de tentoonstelling voor de veiling kunnen de liefhebbers zich rekenschap geven van de staat van de boeken en prenten. Deze zullen na toewijzing onder geen enkel voorwendsel teruggenomen worden. De boeken per order gekocht, dienen te worden nagezien binnen de 7 dagen na toewijzing. Na deze termijn zal iedere terugname of terugzending geweigerd worden.

6. Boeken vermeld met nc zijn niet gecollationeerd en worden verkocht zonder waarborg evenals loten met 2 of meer titels, reeksen en tijdschriften.

7. De veilinghouder zal opdrachten van kandidaat kopers die de veiling niet kunnen bijwonen zonder bijkomende kosten uitvoeren. De opdrachten in euro moeten ten laatste één dag voor de veiling schriftelijk gegeven worden. Telefonische biedingen kunnen vanaf 250 euro volgens beschikbare lijnen. Het veilinghuis is niet verantwoordelijk voor mogelijke problemen bij de telefoonverbindingen. Bij identieke biedingen heeft het eerst geregistreerde bod voorrang.

8. De kopers kunnen hun aankopen na betaling in ontvangst nemen onmiddellijk na de veiling of maandag 11 en dinsdag 12 maart in Groeninge 34 te 8000 Brugge vanaf 10u00 tot 12u00 en van 14u00 tot 18u00. Ná 13 maart op afspraak, in de veilingzaal.

9. De loten worden slechts verzonden na betaling en op kosten en risico van de koper.

10. Bij rouwkoop of in geval van niet-weghaling van de aangekochte goederen, zullen deze opnieuw mogen verkocht worden op volledige verantwoordelijkheid van de ingebreke gebleven koper, met dien verstande dat de nalatige koper aansprakelijk is voor een eventuele minopbrengst, doch omgekeerd geen aanspraak kan maken op een hogere opbrengst.

11. In geval van betwisting zijn enkel de rechtbanken van Brugge bevoegd.

 

CONDITIONS GÉNÉRALES

1. Vente aux enchères par le Ministère des Huissiers de Justice Philippe Willems, Gistelsesteenweg 418, 8200 Brugge Sint-Andries.

2. La vente se fait strictement aux comptant en euros.

3. Les acquéreurs payeront 24 % en sus des enchères, frais et TVA compris. En outre et le cas échéant, un droit de suite sera appliqué, concernant les œuvres d’art originales d’artistes décédés il y a moins de 70 ans ; il sera de 4% pour les adjudications égales ou supérieures à 2000 euros.

4. En cas de contestation, le lot sera immédiatement recrié.

5. L’exposition préalable à la vente permet aux amateurs de se rendre compte de la condition des ouvrages. Ceux-ci ne seront repris sous aucun prétexte une fois l’adjudication prononcée. Les livres achetés en commission devront être collationnés dans les 7 jours qui suivent la vente. Passé ce délai, tout retour, pour quelque motif ce soit, sera refusé.

6. Les livres signalés comme nc ne sont pas collationnés et ne seront pas repris, tout comme les lots de deux livres ou plus, les séries et les périodiques, vendus sans garantie.

7. L’expert se charge d’exécuter les ordres d’achat sans frais supplémentaires pour autant qu’ils soient remis sous forme écrite en euro au plus tard la veille de la vente. Les enchères téléphoniques peuvent être réservées préalablement à partir de 250 euros. En aucun cas la salle de vente ne pourra être tenu responsable d’un problème de liaison téléphonique. En cas de double enchère, la première enregistrée a priorité.

8. Les acheteurs peuvent prendre livraison de leurs acquisitions, après payement, immédiatement après la vente ou lundi 11 et mardi 12 mars à Groeninge 34, 8000 Brugge de 10h00 à 12h00 et de 14h00 à 18h00. Après 13 mars sur rendez-vous.

9. Les marchandises ne seront expédiées qu’après payement complet, aux frais et aux risques de l’acheteur.

10. En cas de non payement, une mise en demeure sera signifiée après un mois, à la suite de laquelle l’expert pourra disposer des biens et les remettre en vente aux frais de l’acheteur.

11. En cas de litige, les Tribunaux de Bruges sont seuls compétents.

 

CONDITIONS OF BUSINESS

1. The auction will be conducted under the supervision of Philippe Willems, Bailiff, Gistelsesteenweg 418, 8200 Brugge-Sint-Andries.

2. Payment of the Purchase Price is due immediately after the sale in cash.

3. The buyers will pay a buyer’s premium of 24 % on the last bid, including V.A.T. and fees relating to the auction ; eventually plus the resale tax, if applicable: 4 % for hammer prices from 2000 euros on, only for original art and if the author died less than 70 years ago.

4. In case of a dispute, the lot will immediately be called again.

5. During the exhibition of the books the candidate buyers will be able to verify the condition of the books and prints. The books and prints cannot be returned for any reason after the fall of the hammer. If the auctioneer has executed a written bid on behalf of the buyer (see section 7), the buyer has to verify the books and prints within 7 days after the fall of the hammer. After this period the books and prints cannot be returned for any reason.

6. Books designated “nc” are not collated and will be sold without guarantee even as lots of 2 or more titles, series and periodicals.

7. The auctioneer will execute written bids on behalf of those candidate buyers who are unable to attend the auction. The bids instructions have to reach the auctioneer no later than the last day before the auction. They have to state the maximum prices in euro and they should be in writing. In the event of identical bids, the earliest received will take precedence. Bidding by telephone will only be accepted for items estimated higher than 250 euros. The auctioneer cannot be held responsible for any problem due to difficulties with telephone connections.

8. The buyers can take delivery of the books immediately after the auction or Monday and Tuesday March 11 th and 12 th, Groeninge 34, 8000 Bruges from 10 am till 12 am and from 2 pm until 6 pm. Or later by appointment.

9. The goods will only be shipped after payment of the full price. Risks and costs of the shipment will be born by the buyer.

10. If full payment has not been made after one month, the auctioneer can rescind the sale of the lot(s) at any other auction. All charges being at the expense of the defaulting buyer.

11. The Courts of Bruges are to have exclusive jurisdiction to settle all disputes arising in connection with all aspects of all matters or transactions to which these Conditions of Business relate or apply.
